Why does Texas have 254 counties?
Texas counties grew out of the 23 municipalities of Spanish and Mexican Texas, which became counties of the Republic of Texas in 1836. Under the Republic, a new county could be set up when 100 free male inhabitants of an area of at least 900 square miles petitioned for one. As settlement spread west, the number kept growing. A guide by the County Judges and Commissioners Association of Texas says counties were created to put a court within a day's horseback ride of the county seat. The Constitution of 1876 required counties formed from unorganized land to cover at least 900 square miles and to be square if possible. Kenedy County, created in 1921, was the last new county. Texas has had 254 counties since Loving County was organized in 1931.
